Procedure for non-fault "damage only" claims
- Once your claim is reported, your Panel Solicitors will be in touch identifying their name, address, phone number and the claims reference number for your claim.
- They will be looking for an admission of liability from the insurers of the other driver.
- If liability is conceded, then as soon as your claim can be quantified (the repair account or policy excess is made available along with any hire account or other losses), the Panel Solicitors will send a schedule of your losses to the other driver and either a settlement cheque will be received or the Panel Solicitors may suggest Court proceedings to speed things along.
- The process should not take more than about three months if there is no complicating factor.
Procedure for claims involving an injury
- In addition to all the above, the Panel Solicitors will discuss with you obtaining any treatment such as physiotherapy to help you recover.
- As the process of your claim will take longer in view of your injury, the Panel Solicitor will be attempting to obtain an interim payment (a payment on account) for your out-of-pocket expenses.
- In most minor injury claims and usually after treatment has taken place, you will need to attend a local independent GP for a medico-legal examination.
- Normally the GP’s report will be disclosed to you for approval before it is sent to the insurers of the driver responsible.
- Once the insurers have seen the report they will normally make an offer of compensation for your injuries. Your Panel Solicitors will advise you if it is broadly speaking reasonable but may suggest that they attempt to negotiate a slight increase.
- Where a complete recovery has taken place (with or without treatment), many injury claims can be settled within three to six months of the accident.
- You should not however be tempted to settle an injury claim too soon if you have continuing symptoms.
